By accessing or using XemailCampaign, You agree to comply with and be bound by these Terms. If You do not agree, do not use our Services.

Your continued use of the Services after such modifications constitutes acceptance of the updated Terms.

- Service: The XemailCampaign platform, which offers features such as email reports, inbox placement tests, and intelligent email warm-up technology to improve sender reputation and ensure cold emails land in the primary inbox.
- Intellectual Property Rights: Rights to patents, trademarks, copyrights, designs, software, and related materials owned by XGrowth or licensed to us.
- Operating Policies: The guidelines and practices that govern the operation of the Service, including our Privacy Policy and Sending Policy.
3. Use of the Services
3.1 Permitted Use
You agree to use the Services in compliance with these Terms and applicable laws. You must not:
- Disrupt or interfere with the functioning of the Services.
- Use the Services for unlawful, fraudulent, or unethical purposes.
- Share access credentials or resell the Services without explicit permission.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and ensuring secure access to your account.

4. Service Levels and Support
4.1 Service Commitment
We strive to maintain high service uptime and provide tools to monitor inbox placement and sender reputation. We also provide automated and real-time tools to monitor your inbox and improve domain health.
4.2 Support
Support is available at support@xemailcampaign.com and is limited to addressing account-related and technical issues. Support is available to the primary account holder or designated Administrator.
5. Intellectual Property
All content, features, and software related to XemailCampaign are protected by intellectual property laws. You may not reproduce, distribute, or modify without prior written consent from XGrowth.
6. Data Privacy
XGrowth processes data in compliance with applicable privacy laws. For details, please refer to our Privacy Policy.
7. Limitations and Fair Usage Policy
To maintain service quality, XGrowth enforces a Fair Usage Policy:
- Maximum daily warm-up actions or account connections, depending on your plan.
- Excessive usage beyond standard rates will be charged on a prorated basis.
8. Termination
XGrowth may suspend or terminate your access to the Services without liability if You:
- Breach these Terms.
- Engage in activities harmful to the Services or its users.
Refunds will not be provided for terminated accounts due to violations.
9. Liability Disclaimer
XGrowth is not responsible for:
- Loss or destruction of data resulting from your use of the Services.
- Indirect, consequential, or incidental damages arising from Service interruptions.
Our total liability for any claim is limited to the amount You paid for the Services in the 12 months preceding the claim.
10. No Refund Policy
All purchases made on XemailCampaign are final and non-refundable. Given the nature of our digital services, we do not offer refunds or exchanges once a subscription or one-time service has been purchased.
11. Governing Law
These Terms are governed by the laws of the United States. Any disputes shall be resolved in courts located in the United States.
